Dmarkb monitors trademark filing databases, domain registrations and marketplace listings for marks that may be similar to the marks you register with us. It scores similarity, flags candidates above your configured threshold, compiles evidence reports and tracks renewal and filing dates for your own marks.
02Not legal advice
Dmarkb is a monitoring and evidence tool. It is not a law firm and does not provide legal advice. Similarity scores and flags are not findings of infringement, likelihood of confusion or registrability.
Dmarkb does not file oppositions, applications or renewals, and does not send legal notices on your behalf. Decisions about any action remain with you and your counsel.
03Your account
- Provide accurate information when you sign up and keep it current.
- Keep your login credentials confidential. You are responsible for activity on your account.
- Only register marks for monitoring that you own, are licensed to use, or are authorised to watch on a client's behalf.
04Coverage and availability
Coverage of registers, domain sources and marketplaces is confirmed per account and depends on what each source publishes and when. We cannot guarantee that every similar mark will be detected, or that sources will publish on a fixed schedule. We aim to keep the service available at all times, but maintenance and events outside our control may cause interruptions.
05Acceptable use
You agree to use Dmarkb in line with our Acceptable Use Policy, including not using reports to harass third parties or make claims you know to be unfounded.
06Plans and fees
Fees depend on the plan and scope agreed with you, and are payable as set out in your order or invoice. Refunds are handled under our Refund Policy.
07Intellectual property
The Dmarkb software, scoring methods and website remain ours. Evidence reports generated for your account may be used freely by you and your advisers for your own matters. Public source data remains subject to the terms of the source that published it.
08Limitation of liability
To the extent permitted by law, Dmarkb is not liable for indirect or consequential loss, or for loss arising from a similar mark not being detected, a deadline being missed, or any decision made on the basis of a report. Our total liability for any claim is limited to the fees you paid for the service in the twelve months before the claim arose.
09Suspension and termination
You may close your account at any time. We may suspend or close an account that breaches these terms, after notice where reasonable. On closure, monitoring stops and data is handled as described in our Privacy Policy.
10Changes to these terms
We may update these terms as the service develops. Material changes will be notified to account holders by email before they take effect.
